Intellectual Property & Copyright Policy

1. Introduction
INTERTRADING HOLDING LIMITED ("we", "us", or "our") respects the intellectual property rights of others and expects our users to do the same. This Intellectual Property Policy describes how we handle reports of copyright infringement, trademark violations, and other intellectual property disputes on the ScrapBull platform.
As a UK-based company, we operate in compliance with the Electronic Commerce (EC Directive) Regulations 2002 and the Copyright, Designs and Patents Act 1988. Additionally, for the benefit of our international users and service providers, we voluntarily adopt the notice-and-takedown procedures outlined in the US Digital Millennium Copyright Act (DMCA).
2. Copyright Infringement (Notice and Takedown)
If you believe that material available on our platform infringes your copyright, please let us know immediately. We respond expeditiously to valid notices of alleged infringement.
2.1 How to Submit a Takedown Notice
To file a valid notice, you must send a written communication to our Designated Copyright Agent including the following:
- Identification of the Work: A description of the copyrighted work you claim has been infringed (e.g., "My photograph of copper wire bundles").
- Identification of the Material: The specific URL(s) or location on ScrapBull where the infringing material is found.
- Contact Information: Your full name, address, telephone number, and email address.
- Statement of Good Faith: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy: A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
- Signature: A physical or electronic signature of the copyright owner or authorized agent.

2.2 Our Response
Upon receipt of a valid notice:
- We will remove or disable access to the allegedly infringing material.
- We will make a reasonable attempt to contact the user who posted the material ("Alleged Infringer") to notify them of the removal.
3. Counter-Notice Procedure
If you are a user who had content removed and you believe it was a mistake (e.g., you own the rights or have a license), you may submit a Counter-Notice.
3.1 How to Submit a Counter-Notice
Send a written communication to legal@scrapbull.com including:
- Identification: The specific content that was removed and its former location (URL).
- Statement: A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Contact Info: Your name, address, and phone number.
- Jurisdiction Consent: A statement that you consent to the jurisdiction of the courts in England and Wales (and the Federal District Court for the judicial district in which you are located, if in the US).
- Signature: Your physical or electronic signature.
3.2 Restoration
If we receive a valid Counter-Notice, we will forward it to the original complainant. Unless the complainant notifies us that they have filed a court action against you within 10 business days, we may restore the content.
4. Trademark Infringement
We also prohibit the listing of counterfeit goods or items that infringe on registered trademarks.
4.1 Reporting Trademark Violations
If you are a trademark owner and believe a user is infringing your trademark (e.g., selling non-branded goods using your logo), please email legal@scrapbull.com with:
- Your Trademark Registration Number and jurisdiction (e.g., UK IPO, EUIPO).
- Details of the infringing listing.
- Evidence that the goods are counterfeit or infringing.
We act on clear cases of infringement by removing listings and potentially suspending the seller.
5. Repeat Infringer Policy
In accordance with applicable law, ScrapBull adopts a strict "Three Strikes" policy for repeat infringers.
- We maintain a record of DMCA/Copyright notices derived from unique users.
- If a user is determined to be a "Repeat Infringer" (typically 3 valid strikes), their account will be permanently terminated.
- We reserve the right to terminate accounts immediately for flagrant or willful infringement.
6. Liability for False Claims
Warning: Under the DMCA and UK law, if you knowingly misrepresent that material is infringing (or was removed by mistake), you may be liable for damages, including legal fees and court costs. If you are unsure whether content infringes your copyright, please consult a solicitor/attorney before reporting.
